  • The articles found on this blog are applicable to allIF Petitions, K1 Visa Applicants, AOS (from a K1 Visa), and ROC applicants unless otherwise noted. The Adjustment of Status (AOS) Package will be the last application you will send USCIS &#; at least for the next 2 years. This application process usually lasts for about 6 months and one (more often than not) will quite possibly have an interview towards the end. Having an AOS approval will result into having a Green Card (2-year GC for K1 adjusters) that is proof of your legal permanent residency in the US. If you applied for both an I Employment Authorization Document (EAD) / I Advance Parole (AP), this will most likely be issued half-way through the whole AOS process, which is months from filing.

Below I have prepared Two (2) Checklists for Preparing your AOS Package

 

  • The first one is just a regular checklist that everybody uses.
  • And the second one is my actual checklist of our front-loaded AOS Package. (Just so you know in full detail what I have included in mine.) We also used a co-sponsor / joint sponsor. Front-loading means you include all possible documents and evidences that may be asked of you for your interview later on in the process.

Tips to Remember when Preparing your AOS Package:

 

  • It&#;s cleaner and more organized if you label your documents and separate them in folders. Especially if you&#;re applying for EAD and AP, too. (THIS is just my opinion and nobody else&#;s. Immigration Officers look at paperwork all day. They&#;re human, they CAN mix up paperwork if not properly organized. Some even claim to get RFE&#;s even if they sent in complete documents. Segregating / Organizing paperwork isn&#;t really a negative thing / wrong thing to do. For me, it actually makes it easier to look at.)
  • All forms must be completed and signed in BLACK INK.
  • A Social Security Number (SSN) is ideal BUT not requiredfor AOS. You can apply for an SSN under your married name AFTER you get your EAD/AP Combo Card. Use 0&#;s (zeroes) instead.

  • NEVER leave BLANKS on your forms. (Of course, unless otherwise noted in the instructions. Read question directly below this list.) Use &#;N/A&#;, &#;NONE&#;, or &#;0&#; if the form permits. Better yet, call the USCIS Hotline if you&#;re in doubt.

What if the answer is &#;Not Applicable&#; or &#;None&#;? Do I write &#;NONE&#;, &#;N/A&#;, or leave it blank?

I Adjustment of Status Form (06/20/13 Edition; Expires 06/30/): Revised USCIS Forms indicate that you are supposed to leave it blank (Page3).(I still used &#;NONE&#; or &#;N/A&#; on my forms and didn&#;t get an RFE!).

I Application for Employment Authorization (08/06/14 Edition; Expires 04/30/): General Instructions, Page 6 specifically says &#;Answer all questions fully and accurately. State that an item is not applicable with &#;N/A&#;. If the answer is none, write &#;None&#;.

I Application for Travel Document (03/22/13 Edition; Expires 03/31/):  General Instructions, Page 7  says &#;Answer all questions fully and accurately. State that an item is not applicable or the answer is none, print or type &#;N/A&#;.

Do note that USCIS, at any time, can revise/update their form&#;s instructions.Read them carefully.

 

A Note to K1 Visa &#;Adjusters&#; from the Philippines:

You don&#;t need to send in your St. Luke&#;s Medical Examination Chest X-ray CD along with your AOS Paperwork. It will be sent back to you. You only need to have your DS Vaccination Record.

 

A Note to ALL K1 Visa Adjusters:

You don&#;t need to have another FULL Medical for Adjustment of Status (AOS). It&#;s up to you to&#;

(1)Risk just sending the DS Vaccination Records. I&#;ve heard a lot of people were lucky enough to have their AOS approved with just this. It&#;s entirely your and your spouse&#;s decision.

(2) OR If you opt to go to a Civil Surgeon to have your DS Form Vaccination Record transcribed / transferred to an I form for your peace of mind. It should only cost you a few bucks. Most definitely NOT over USD$

AGAIN, (You areNOT REQUIREDto have a FULL Medical if your overseas K1 Medical exam is within 1 year upon applying for AOS.) Check the Form I Instructions, too.

My Front-Loaded AOS Package / Packet

Some documents below are not really required for the AOS process (like evidences of intermingling of finances, relationship evidences) but we already have everything in order (did / updated everything in less than a month!), so why not include it in the packet, right? It wouldn&#;t hurt to send in extra paperwork anyway. We also opted to apply for an EAD (Work Permit) because I wanted to work as soon as possible and help with finances. We also opted to apply for AP (Travel Permit) just for emergency purposes. Both EAD & AP&#;s filing fees are waived when filed WITH the AOS application anyway.

 

***LET ME JUST REITERATE:
This is my personal list. It may seem excessive for some people but this is what I CHOSE to send. And THIS is how I send in ANY application no matter what process it is. I&#;m a very organized person. An overly organized one. You don&#;t have to follow what I did exactly. You don&#;t have to have every bit of paper notarized. Though having stuff notarized isn&#;t a bad thing. It only proves the document&#;s authenticity.

There is no wrong or right way of arranging your AOS Packages. Just as long as you abide by the list ABOVE (not this personal list I have below).

The result of my AOS are the following:

(Rant: Maybe. JUST MAYBE my organized/labelled folders/duplicate/notarized copies were easier for the immigration officer to adjudicate/decide on since I&#;ve provided everything they would&#;ve asked for in terms of proof of marraige and financial support/stability for the supposed AOS Interview. The very same AOS Interview I got waived for by USCIS themselves. If I did anything wrong, and if you -think- what I did is utter stupidity, why did my AOS go so well? Think about it. :P)

    Extra Documents?

    I've been looking through this forum for some time now for guidance on filing my I, I and I concurrently. One thing that caught my attention is that many people are submitting documents not listed in the form instructions. I'm not talking about stuff like relationship photos and documents, since the instructions do specify that you should include them. But there are some that I simply cannot find listed in the instructions. For example, beneficiary's birth certificate with the I, submitting BOTH birth certificate and passport of petitioner with I when only either is needed to prove citizenship, beneficiary's passport/visa with I, beneficiary's passport biographical page with I when instructions only ask for page containing the visa (some people even submit copies of all pages??), form GA for both petitioner and beneficiary with I when it only asks for one from the beneficiary. There are several more I can list, but these are just some of the examples.

    I've gathered from here that the cover letter (also not listed) is highly recommended, but I've been wondering about the reasoning behind the other additional documents. Do they reduce the chances of denial/RFEs, or do people just do it because they're paranoid and want to "cover all the bases".

    This forum has truly been a wonderful resource for me and I thank you for your kind input.

    You pose a good question, and I'll offer some response.

    Over the years, requirement stipulations on various forms have changed, been dropped, or been added. Many instructions people read or hear are outdated or based on misinterpretations.

    Examples of such additional or unncessary evidence are:
    1. Affidavits for I
    2. Second GA for petition with I
    3. Bank letter with I
    4. COVER LETTER
    5. Passport and birth cert for petitioner of I (and IF), or even Naturalization Certificate
    6. Evidence of cohabitation and/or commingling of financial affairs with I when submitted at same time as I

    At various time in the past, or present, all of the above have been included on form instsructions, dropped, not paid attention to by reviewers, then RFE' s sent by reviewers if absent.

    I see, so it is more an issue with the USCIS reviewers sticking to old instead of updated procedures. I suppose it wouldn't hurt for me to do the same, to avoid the scenario you mentioned about the RFE.

    You must have a USCIS-listed doctor complete an immigrant medical exam on form I and give to you in a sealed envelope.

    The fee will be between $80 and $, depending on which vaccinations he gives you.

    I'm also in the process of getting my packet together with forms I, I and I My question is do we need to submit one set of passport photos and evidence copies for each application?

    The I needs one passport-style photo each from petitioner and beneficiary.
    The I, I and I need two passport-style photos from beneficiary only.
